A — Terms of Sale
1. Seller Identification
The OPS platform is published and operated by Staudt-IT, a sole-trader enterprise (Florian Staudt) registered in France, 57520 Grosbliederstroff. Contact: contact@staudt-it.com / contact@ops-music.com. These terms govern all subscriptions and purchases made on ops-music.com and app.ops-music.com.
2. Services & Products
OPS is a Software-as-a-Service (SaaS) platform for orchestras, music schools and individual musicians. It includes a web application (app.ops-music.com), the OPS Scores iPad app (available on the Apple App Store), and the OPS Mobile iPhone app. The features available depend on the subscription plan chosen.
3. Pricing & Payment
Prices are displayed in euros (EUR) inclusive of applicable taxes. Subscriptions are billed monthly or annually, as chosen at sign-up. Annual billing offers a discounted rate. Payment is processed securely by Stripe. Staudt-IT reserves the right to modify prices; existing subscribers will be notified at least 30 days in advance of any change.
4. Free Trial & Free Plan
A free plan is available indefinitely with limited features. Paid plans may include a free trial period as displayed at sign-up. No credit card is required to create a free account.
5. Renewal & Cancellation
Subscriptions renew automatically at the end of each billing period unless cancelled beforehand. You may cancel at any time from your account settings or by contacting contact@ops-music.com. Cancellation takes effect at the end of the current billing period; no partial refunds are issued for the remaining period.
6. Right of Withdrawal
If you are a consumer resident in the European Union, you have the right to withdraw from a paid subscription within 14 days of the initial purchase, without giving a reason, provided you have not materially used the paid features during that period. To exercise this right, contact contact@ops-music.com. Once the 14-day period has elapsed, or if paid features have been actively used, no refund applies.
7. Data on Cancellation
After cancellation or account deletion, your data is retained for 30 days during which you may request an export. After that period, all your data is permanently deleted from our servers.
8. Mobile Apps — App Store Purchases
The OPS Scores and OPS Mobile apps are available on the Apple App Store. Purchases made through the App Store are subject to Apple's own terms and conditions. Staudt-IT has no control over App Store transactions; refunds for App Store purchases must be requested directly from Apple.
9. Intellectual Property
The OPS platform, its source code, visual design, and all associated software are the exclusive property of Staudt-IT. Your subscription grants you a non-exclusive, non-transferable right to use the Service. You retain full ownership of all content you upload (scores, documents, member data). By uploading content, you confirm that you hold the necessary rights to store and process it on OPS.
10. Limitation of Liability
The Service is provided with reasonable care. Staudt-IT shall not be liable for indirect or consequential damages arising from use of the Service. Our total liability to you shall not exceed the amount paid in the 12 months preceding the claim.
11. Governing Law & Disputes
These Terms are governed by French law. In the event of a dispute, the parties shall seek an amicable resolution first. If that fails, disputes shall be subject to the jurisdiction of the competent French courts. EU consumers may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr/.

12. Acceptance
By accessing or using ops-music.com or app.ops-music.com ("the Service"), you agree to be bound by these Terms. If you do not agree, please do not use the Service.
13. Accounts
You are responsible for maintaining the confidentiality of your account credentials. You must provide accurate information when creating an account. You may not share your account or use the Service for any unlawful purpose.
14. Your Data
You retain ownership of all data you upload to OPS. By using the Service, you grant Staudt-IT a limited licence to store and process that data solely to provide the Service. We do not sell your data to third parties. See our Privacy Policy for full details.
15. Termination
You may stop using the Service at any time. Staudt-IT reserves the right to suspend or terminate access, particularly in cases of abuse or violation of these Terms.
16. Changes to These Terms
We may update these Terms at any time. Registered users will be notified of material changes by email. Continued use after a change constitutes acceptance of the new Terms.
